Terms of Service

Agreement

These terms are an agreement between you and Luca ("Luca", "we", "us"). By texting LUCA or using the service, you agree to them. You must be 18 or older and a resident of the United States.

What Luca does

• Luca reviews bills and receipts you send us, looks for savings, and, when you reply YES, contacts providers as your representative to ask for a lower price, a correction, a refund, a fee reversal or a cancellation on accounts you already have. Luca can also help you claim cashback, FSA or HSA money and unclaimed money held by a state, and sell items you no longer use.
• Some things only you can do, and Luca will tell you how: cancelling a subscription that can only be cancelled inside your own account, filing an FSA claim, and claiming money a state is holding for you, which requires the state to check your identity.
• Luca is not an insurance agency or broker. We don't sell insurance, quote or recommend policies, or change your coverage. We don't give legal, tax, medical or investment advice.

Your authorization

When you reply YES to a proposed action, you authorize Luca to contact the named provider on your behalf about that account. Because some companies only talk to the account holder, we ask you once to sign a written authorization to act, which covers price reviews, corrections, refunds, fee reversals and cancellations you ask for, and never opening accounts, changing plans or coverage, or moving money. For medical bills we also ask you to sign a HIPAA authorization naming Luca. You can withdraw any authorization at any time by texting REVOKE.

Price and the $19 guarantee

• Luca costs $19 a month. There is no success fee and no percentage of what you save.
• You aren't charged until Luca has verified at least $19 in savings or earnings for you. After that, your plan renews monthly until you cancel. Credits from referrals and Savings Circles are applied to your invoices automatically.
• Resale fees are listed under Resale below.

Resale

• Luca is a listing and matching service. We write your listing, post it on our own pages and on local classifieds, answer buyers and book a meetup. We are not a marketplace, an escrow agent or a payment processor, and we never hold or take a share of the sale price.
• Sellers pay a $15 listing fee before a listing goes live; it's free for members on the $19 monthly plan. The fee isn't refundable, but it comes back as Luca credit once 3 people you invited have each completed a transaction.
• Buyers pay a $20 commitment deposit and a $5 service fee to book a meetup. The buyer inspects the item and pays the seller directly, by any method they agree. The deposit is refunded after the meetup whether or not the buyer buys. If the buyer doesn't show up, the deposit is kept by Luca. If the seller doesn't show up, the buyer gets the full $25 back.
• To confirm a meetup took place, both people check in from a link on their phone, which shares their location once. We use it for nothing else.
• We don't inspect items and don't guarantee their condition, description or ownership. Meet in a public place. Stars earned in resale have no cash value and can only be used as described in the app; we can remove stars earned through misuse.

Text messages

• Luca's text program sends account messages about your bills and savings: what Luca found, requests for your OK, updates when a company replies, confirmed savings and your weekly summary. Referral and feature messages are sent only if you agree to them separately.
• You join by texting LUCA to our number or by ticking the text-message box when you sign up. Message frequency varies with your account activity. Message and data rates may apply.
• Reply STOP at any time to stop all messages; you'll get one confirmation and nothing after that. Reply START to turn them back on. Reply HELP for help, or email hello@luca.network.
• Carriers are not liable for delayed or undelivered messages.

Cancelling

Text CANCEL at any time. Cancellation takes effect at the end of the current billing month, and we don't charge you again. Text STOP to stop all messages.

Referrals and Savings Circles

A friend you refer gets $19 in credit. You get $19 when they save for the first time and another $19 when they pass $100 in savings. Credits are capped at 10 a month, can't be exchanged for cash, and are void for duplicate accounts, self-referrals or abuse.

Savings Circles have 2 to 6 members from one household. When two or more members are on a paid plan, each gets a one-time $10 credit on that same month's bill; a member who joins later gets theirs in the month they join. The credit is not repeated in later months. When a Circle's verified savings reach $5,000, each member gets one free month.

Results

Savings estimates are estimates. Providers decide whether to lower a price, and we can't guarantee any particular result. Beyond the $19 guarantee above, Luca is provided as is.

Your responsibilities

Send us accurate information and only bills and accounts that are yours or that you're authorized to manage. Keep paying your bills on time while we work on them unless a provider confirms a hold.

Liability

To the extent the law allows, Luca's total liability for any claim is limited to the amount you paid us in the 12 months before the claim, and we aren't liable for indirect or consequential losses.

Governing law and changes

These terms are governed by the laws of the State of California. We may update them; if a change is material we'll tell you by text before it applies. Questions: hello@luca.network.
